Terms of Use and Terms and Conditions

For the Curvalia app – the free features as well as Curvalia Plus, the subscription in the app. Please read sections 6 to 8 in particular: they concern your safety in road traffic.

1. Provider and scope

The provider of the Curvalia app (hereinafter “we”) is:

These terms apply to any use of the Curvalia app and the services connected with it (route calculation, navigation, account, friends, group ride, leaderboard). Sections 2 to 5 additionally apply to Curvalia Plus. You conclude the purchase of Plus itself with Apple or Google respectively (section 3). The contract language is German.

2. Subject matter of the contract

The free features are provided to you free of charge and on a voluntary basis. There is no entitlement to them or to their permanent availability; we may change, restrict or discontinue them at any time.

Curvalia Plus is a subscription that unlocks additional features in the app. At the time of conclusion, these are:

• Offline maps
• Alternative routes
• Round-trip dice
• Destination dice
• Weather in planning
• GPX export of routes
• POI filter on the map
• Unlimited saved routes
• Create your own dream roads

Features added to Plus during your term are included at no extra charge.

3. Purchase via the App Store and Google Play

From the 2027 season, Curvalia Plus is purchased as a subscription exclusively in the app – via the App Store (Apple) or Google Play (Google). Nothing is sold on this website.

The seller is Apple or Google respectively. Payment, invoicing, renewal, cancellation and withdrawal are governed by their terms. You cancel in the subscription settings of your Apple or Google account.

4. Updates and availability of Plus

During the term, we provide you with the updates that are necessary to keep the product in conformity with the contract, and we inform you about them (§ 327f BGB). There is no entitlement to any particular feature remaining unchanged, as long as the agreed scope of services is maintained overall.

Curvalia uses map data and services of third parties (including OpenStreetMap, OpenFreeMap, MET Norway, Open-Meteo). Disruptions or changes to these services are beyond our control. We do not owe uninterrupted availability; your statutory rights in the event of lasting defects remain unaffected.

5. Defects in Plus

The statutory provisions for digital products apply (§§ 327 ff. BGB). If the unlocking is defective, you may demand subsequent performance and, under the statutory conditions, reduce the price or terminate the contract.

6. Use in road traffic

Curvalia is an aid for planning and orientation. Responsibility for driving your vehicle, for the choice of route and for compliance with all traffic regulations lies solely with you.

• The actual traffic situation, the signage and the instructions on site always take precedence – even if the app shows or announces something different.
• Road layouts, speed limits, gradients, closures, opening times of mountain passes, toll information and weather come from open or third-party data sources and from reports by other users. They may be outdated, incorrect or incomplete. We do not check them.
• Suggested routes may lead over roads that are closed, subject to tolls, seasonally closed, temporarily closed to motorcycles, in poor condition or unsuitable for your vehicle and your skills. Check the route before you ride.
• Announcements and the position display may be delayed, wrong or absent altogether – for example with weak GPS reception, no network, a flat battery or faults in the device.
• Do not operate the app while riding. Make entries only when stationary; the phone belongs in a secure mount.
• Curvy profiles, mountain passes and dream roads require experience. The curve and flow scores describe the course of the road, not the difficulty, condition or safety of a road.

7. Offroad profile and unpaved tracks

The Offroad (Beta) profile suggests routes over gravel, field, forest and agricultural tracks. It is based on OpenStreetMap, a database maintained by volunteers. We do not check whether a track is open to motor vehicles.

• Suggested tracks may be prohibited for motor vehicles or open only to certain users (such as agricultural and forestry traffic or residents), may lie on private land or lead through protected areas in which driving is prohibited. In Germany, for example, driving motor vehicles on forest tracks is generally prohibited under the forest laws of the federal states; other countries have their own rules.
• Whether you are allowed to use a track, you must check yourself before every ride – on the basis of the signage on site and the regulations applicable there. If in doubt, do not ride it.
• We do not know the condition and passability of the tracks (potholes, washouts, gradients, fords, barriers). You decide whether the track, the vehicle and your skills are a match.
• Fines, warnings, towing and recovery costs as well as claims by landowners or authorities arising from your use of a track that is not open to you are borne by you.

8. Scores, leaderboard and group ride

Levels, badges, the curve and flow scores and the leaderboard reward no speed and are no invitation to ride fast or take risks. Curvalia must not be used for races, speed contests or record attempts on public roads.

On a group ride, each person rides on their own responsibility. The displayed positions of other riders may be delayed or inaccurate; they are no substitute for keeping your distance, making arrangements and looking for yourself.

9. Content from other users

Reported closures, user-created dream roads, names and other contributions come from users. We do not check them and give no warranty for their accuracy. You are responsible for content you post yourself; it must not infringe the rights of third parties and must not be offensive or unlawful. We may remove such content without prior notice and suspend your account in the event of violations.

10. Liability

Free features: As we provide them free of charge, we are liable for them only in the case of intent and gross negligence.

Curvalia Plus: In the case of simple negligence, we are liable only for breach of a material contractual obligation – that is, an obligation whose fulfilment is essential to the proper performance of the contract in the first place and on whose observance you may regularly rely – and limited in amount to the foreseeable damage typical for this type of contract. Otherwise, liability for simple negligence is excluded.

Loss of data: In the case of simple negligence, we are liable for the loss of data only up to the amount of the effort that would have been necessary to restore it had you kept your account key and backed up your data.

In all cases, the following remain unaffected: liability for damage resulting from injury to life, body or health, liability under the Product Liability Act (Produkthaftungsgesetz), liability for fraudulently concealed defects and for an expressly assumed guarantee; in these respects the statutory provisions apply. The limitations also apply in favour of our vicarious agents and assistants.

If you do not observe the notes in sections 6 to 8, this may constitute contributory fault on your part (§ 254 BGB).

11. Changes to these terms

For a subscription already concluded, the version published here at the time of its conclusion applies. Later changes affect only new contracts and therefore also a later renewal. For the free features, the version published here at the relevant time applies; we will point out material changes in the app.

12. Final provisions

German law applies. If your habitual residence is in another country, the mandatory consumer protection provisions of that country remain unaffected.

Should any provision of these terms be invalid, the remaining provisions remain valid; the invalid provision is replaced by the statutory provision.

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board. The European Commission’s Online Dispute Resolution platform was discontinued on 20 July 2025; a reference to it is therefore omitted.
